These Terms of Service (the "Terms") govern your access to and use of the website located at dnadefect.com (and any subdomains or successor domains) and the purchase of products offered by DNA Defect (collectively, the "Services"). The Services are operated by DNA Defect ("DNA Defect," "we," "us," or "our"). By accessing or using the Services, or by placing an order through the Services, you ("you" or "your") agree to be bound by these Terms, our Privacy Policy, our Shipping Policy, and our Return & Refund Policy, each of which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Services.

Acceptance of Terms

By accessing or using the Services, you represent and warrant that (i) you have read, understood, and agree to be bound by these Terms; (ii) you have the legal capacity to enter into a binding agreement; and (iii) the information you provide to us is true, accurate, current, and complete. We may revise these Terms from time to time in accordance with the Changes to These Terms section below, and your continued use of the Services following any such revision constitutes your acceptance of the revised Terms.

Eligibility

The Services are intended for individuals who are at least eighteen (18) years of age. If you are under the age of eighteen (18), you may use the Services only with the involvement, consent, and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf. By placing an order, you represent and warrant that you meet the eligibility requirements set out in this Section.

The Services

DNA Defect operates an online retail store offering apparel and related products. We reserve the right, at our sole discretion and without prior notice, to modify, suspend, or discontinue any aspect of the Services, including the availability of any product, feature, or content, in whole or in part, at any time.

Products, Descriptions, and Pricing

We make commercially reasonable efforts to display products and their descriptions accurately on the Services. However, we do not warrant that product descriptions, images, colours, textures, or other content are error-free, complete, or current. Slight variations in colour, finish, weave, or fabric batch may occur and shall not be deemed defects. All prices are displayed in Indian Rupees (INR) and, unless expressly stated otherwise, are inclusive of applicable taxes. We reserve the right to modify prices, product offerings, and availability at any time and without prior notice. In the event of a manifest pricing error, we reserve the right to cancel any affected order and issue a full refund.

Orders and Acceptance

Your submission of an order through the Services constitutes an offer to purchase the products selected, subject to these Terms. All orders are subject to acceptance by us, and we reserve the right, in our sole discretion, to accept, decline, limit, or cancel any order for any reason, including but not limited to suspected fraud, payment irregularities, stock unavailability, manifest pricing errors, or violation of these Terms. A contract of sale is formed only upon our confirmation of dispatch.

Payment

At launch, we accept prepaid orders only; Cash on Delivery is not available. Payments are processed by third-party payment service providers, and by completing a transaction you authorise the applicable payment provider to charge the payment method you have selected. We do not store full card details or banking credentials on our servers. You represent and warrant that you are authorised to use the payment method you provide.

Shipping and Delivery

Shipping is currently available within India only. Estimated delivery timelines, charges, and tracking are set out in our Shipping Policy, which is incorporated herein by reference. Title and risk of loss for products pass to you upon delivery to the address provided at checkout.

Returns, Exchanges, and Refunds

Returns, exchanges, and refunds are governed exclusively by our Return & Refund Policy, which is incorporated herein by reference. By placing an order, you acknowledge that you have read, understood, and agreed to the terms of that policy.

Intellectual Property

All content made available through the Services - including, without limitation, the name "DNA Defect," our logos, trademarks, trade dress, product designs, photography, written copy, graphics, and the underlying source code - is owned by or licensed to DNA Defect and is protected by Indian and international intellectual property laws. Except as expressly permitted by us in writing, you may not reproduce, distribute, modify, publicly display, create derivative works of, or commercially exploit any portion of the Services or its content. Nothing in these Terms shall be construed as granting you any licence or right in or to any of our intellectual property.

User Conduct

You agree that you will not, and will not permit any third party to: (a) use the Services for any unlawful, fraudulent, or harmful purpose; (b) attempt to gain unauthorised access to the Services or any related systems or networks; (c) interfere with, disrupt, or impose an unreasonable load on the Services; (d) scrape, harvest, or otherwise extract content or data from the Services; (e) impersonate any person or entity or misrepresent your affiliation with any person or entity; or (f) use the Services in any manner that violates these Terms or any applicable law. We reserve the right to investigate and take appropriate legal action against any violation of this Section.

The Services may contain links to, or otherwise integrate with, third-party websites, applications, or services that are not owned or controlled by us ("Third-Party Services"). We do not endorse, control, or assume responsibility for any Third-Party Services or their content, policies, or practices. Your access to and use of any Third-Party Service is at your own risk and subject to the terms and conditions of that Third-Party Service.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT ANY WARRANTY OR LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DNA DEFECT, ITS FOUNDERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF THE SERVICES OR ANY PRODUCT PURCHASED FROM US, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO ANY ORDER SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THAT ORDER.

Indemnification

You agree to defend, indemnify, and hold harmless DNA Defect and its founders, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with (i) your access to or use of the Services; (ii) your breach of these Terms; or (iii) your violation of any applicable law or the rights of any third party.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of laws principles. You agree that any dispute, controversy, or claim arising out of or relating to these Terms, the Services, or any order shall be subject to the exclusive jurisdiction of the competent courts located in Gurugram, Haryana, India.

Changes to These Terms

We reserve the right to modify or replace these Terms at any time, in our sole discretion. We will indicate any such changes by updating the "Last updated" date at the top of these Terms. It is your responsibility to review these Terms periodically. Your continued access to or use of the Services after any such change constitutes your acceptance of the revised Terms.

Severability and Entire Agreement

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect. These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and DNA Defect regarding the Services and supersede all prior agreements and understandings.
